TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER. You agree to indemnify, defend, and hold harmless QuestCrate and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms or applicable laws; (c) your User Content; or (d) your infringement of third-party rights. - Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict of laws principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association under its rules, seated in the State of Wisconsin, USA, rather than in court, and you waive any right to participate in class actions or representative proceedings. If arbitration is held unenforceable, disputes shall be resolved in the state or federal courts located in Wisconsin. - Force Majeure
We shall not be liable for any failure to perform due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, labor disputes, governmental actions, or supply chain disruptions. - Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full effect. Our failure to enforce any right or provision shall not constitute a waiver of such right. - Entire Agreement
These Terms, together with our Policies, constitute the entire agreement between you and us regarding the Services, superseding any prior agreements.
